General Terms and Conditions Happy Whatever

Happy Whatever designs special cards. These are sold to resellers to resell. Reseller discounts are only suitable for customers who resell our products to the consumer through brick shops or webshops. The consumer can also contact us directly via our own consumer webshop. We deliver at home and abroad.
There is also a possibility to customize one of our products, the Happy Hugs, a card that folds over to a vase, for promotional purposes. Other conditions apply to these customized orders.
When you place an order, the buyer automatically agrees to the Happy Whatever Terms and Conditions.
For Wholesale, a minimum order of € 150, - ex VAT + postage applies.
All prices are ex VAT.
The delivery of our products takes place by means of Letterbox Post or Parcel via Post NL. The buyer ensures that the correct postal address is delivered and is therefore responsible for the consequences of not communicating the correct postal address. Any changes to this must be communicated to us in time.
The shipping costs are the responsibility of the buyer.
Orders up to 20 kilos:
Netherlands: € 6.95
Belgium and Germany: € 9.00
France and Denmark: € 14.00
UK: € 12.00
Upon delivery of an order at a collection point, the buyer receives a message with a collection code by text message or by email. The buyer must handle these details carefully. We are not liable for damage due to careless use of the pick-up code. The buyer must always keep the collection code secret.
WARRANTY AND LIABILITY
On all products that the buyer buys from us there is a legal guarantee. This means that the product must meet the expectation that the buyer may have with normal use of the product.
No warranty claims can be made in the following cases:
a. in case of damage by intent or negligence;
b. with normal wear and tear;
c. in the event of damage due to failure to observe or incorrect use of the operating instructions.
The buyer must report damage to us within 7 days of receipt. We will then send a refund or a new product without extra costs.
The buyer pays at once. The buyer receives an invoice at or after delivery. The total amount must be paid before the stated deadline. The payment term is 14 days. New customers must pay before shipping the product.
The buyer can pay in one of the following ways:
a. Direct transfer via giro
c. PayPal. Additional costs will be charged for PayPal.
If the buyer has not paid or has not paid in full before the final payment date, not even after being reminded of this, the amount due will be increased by extrajudicial collection costs. These collection costs amount to 15% of the outstanding principal sum.
For customized orders and orders above € 5.000, - a down payment of 50% must be made at the acceptation of the order. The remaining 50% must be paid at the latest on the day of delivery.
The buyer has, from the time of receipt of the order, 14 days reflection time, in which he can make use of his right of withdrawal and can dissolve the agreement. The product must be returned in its original condition, including packaging. The costs of the return are for the buyer. Within 30 days of receipt we will refund the invoice amount to the buyer, provided the product is received in the original state.
However, the above does not apply to the customized version. This product is specially made for the buyer and can’t be returned to us. Cancellation is only possible before the start of production.

All disputes arising from or related to the agreement to which these conditions apply will be settled by the Dutch court.
Finally, feedback from our buyers is very important to us. This only keeps us sharp and therefore we can only improve our services and our products. So it would really help us if every buyer wants to give his/her feedback in the form of suggestions, tips, etc. on our products.
